Cited the Court
The petition cited an order given by the Supreme Court on February 4, in which the court asked the Assam government to send the 63 declared foreigners to his country within two weeks, whose citizenship was already decided. But the petitioners say that the Assam government has now started a comprehensive and indiscriminate campaign using this order, in which people are being caught and sent across the border who have not been investigated by citizenship, nor do they have an opportunity to speak.
Poor and deprived class affected the most
The petition also stated that the policy of forcibly sending the border in the border districts of Assam such as Dhubri, South Salamara and Golpada is the most implemented, causing the most damage to the poor and marginalized Indian citizens. These include people who have either been declared foreigners without hearing or who do not have legal help.
Violation of constitution
The petitioners say that this policy is a violation of Article 14 (Right to Equality) and Article 21 (Right to Life and Personal Freedom) of the Constitution. Without a judicial process, it is not only illegal to get anyone out of the country but also inhuman.
What has been demanded?
The petition has demanded from the Supreme Court that no one should be evacuated under the February 4 order until he was duly declared foreigner by a foreign tribunal, his citizenship should not be confirmed from the Ministry of External Affairs and he has not got full opportunity to appeal or review.
